THE RULES
OF THE DESK.
Plain terms for an educational website: what you can expect from TraderInput, and what we expect from you.
Terms of use
USING
TRADERINPUT.
1. Agreement
These Terms of Use govern your use of traderinput.com, its tools, the TraderInput Terminal and our newsletter (together, the “Services”), operated by TraderInput (“we”, “us”). By using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services. You must be at least 18 years old, or the age of majority where you live, to use the Services.
2. Education only
The Services provide general education about futures markets and trading. Nothing in them is investment, financial, legal or tax advice, a recommendation, or an offer or solicitation to buy or sell any security, futures contract, option, currency or other instrument. We do not know your circumstances, and we do not act as your investment adviser, commodity trading advisor, broker or fiduciary. You alone are responsible for your trading decisions and their results. Please read our Risk Disclosure.
3. Simulations, tools and market data
Calculators, trainers, the Decision Lab and replays use synthetic or recorded data, and their results are simulated. The Terminal shows widgets from TradingView and public data from the SEC and the CFTC. Third-party content is provided by its owners under their own terms, may be delayed, incomplete or wrong, and may change or stop without notice. Links to other websites are for convenience; we do not control and are not responsible for them.
4. Programs and paid services
Trader Training, mentoring and any other paid program are offered under a separate agreement that sets out content, schedule and fees before you commit. If that agreement differs from these Terms, the agreement for the program applies to it.
5. Acceptable use
Use the Services lawfully and for your own learning. Do not disrupt or overload them, probe or bypass their security, copy or scrape them in bulk, or send automated requests to the Terminal’s data interface. The Terminal is meant for people reading one company at a time; it relies on public agency data with fair-access limits that we must respect.
6. Intellectual property
The text, graphics, logos, software and design of the Services belong to TraderInput or its licensors and are protected by copyright and trademark law. You may view and print pages for your personal, non-commercial use. Any other use requires our written permission. Third-party marks and content, including TradingView widgets and agency data, remain the property of their owners.
7. Newsletter
If you subscribe, we send educational emails until you unsubscribe through the link in any email or by writing to us. See the Privacy Policy for how your address is handled.
8. Disclaimer of warranties
The Services and all content, tools and data are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, error-free or secure.
9. Limitation of liability
To the fullest extent permitted by law, TraderInput is not liable for any trading or investment losses, or for any indirect, incidental, special, consequential or punitive damages, or lost profits, arising from or related to your use of the Services, even if advised of their possibility. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us for the Services in the twelve months before the claim, or one hundred U.S. dollars (US$100).
10. Indemnity
You agree to indemnify and hold TraderInput harmless from claims, losses and costs, including reasonable attorneys’ fees, that arise from your misuse of the Services or your breach of these Terms.
11. Governing law and disputes
These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-law rules. Any dispute relating to the Services will be brought in the state or federal courts located in New York County, New York, and you and we consent to their jurisdiction. If the law of the place where you live gives you protections that cannot be waived by contract, those protections still apply.
12. Changes and general terms
We may change these Terms; the date at the top shows the current version, and continued use after a change means you accept it. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and Risk Disclosure, are the entire agreement about the free Services.
